If you do not know if your clean-up is taking place on a provincial roadway, please email litterprograms@coastalaction.org. Clean-ups on 100 Series Highways are not permitted.

   

I, on behalf of myself, my heirs, executors, and anyone who may claim on my behalf, agree not to sue and do hereby waive, release, and discharge, to the fullest extent permissible by law, Coastal Action, the Province of Nova Scotia, and the Department of Public Works, and their Ministers, employees, agents, or anyone acting on their behalf, from any claims or liability of personal injury, death, damage to property or loss of any kind and however caused, whether arising by reason of the negligence of Coastal Action, the Province of Nova Scotia, the Department of Public Works, or anyone acting on their behalf, or otherwise.

I shall save and hold harmless the Province of Nova Scotia, the Department of Public Works, and its Ministers, employees, agents, or anyone acting on their behalf, against any and all claims for personal injury and / or property damage of whatsoever nature, that may occur during or after the work performed as part of the approved application, if, in the opinion of the Department of Public Works, any such claim arises from the execution of the approved work.

I also acknowledge the risks involved in the Litter Program, which I am being allowed to undertake freely of my own volition, taking place on the above clean-up date and location.

 

Assumption of Risk Agreement Form

I understand and agree that that the following conditions are requirements of the approved application:

  • A Department representative will be on hand to monitor the litter pickup to ensure the guidelines and conditions are being adhered. The representative will be assisted by two volunteers only from the volunteer group organization for the litter pickup in the quadrants only of the interchange and at other locations where it may be considered a hazard. The Department representative will not assist in litter pickup in the perimeter of the interchange.
  • All participants must be 12 years of age or older. Every six participants aged 12-17 require one adult supervisor (19 years or older) who must be present at all times during the litter clean-up operation to ensure compliance with the conditions.
  • A trained individual trained in First Aid and equipped with a #2 First Aid Kit must be at the litter clean-up site.
  • The Department of Public Works reserves the right to limit the number of volunteers on an adopted section of highway Right-of-Way.
  • All the sponsoring group members who will perform a litter clean-up through 100 Series Highway Interchange Pilot Project must sign the “Acknowledgment Form A” to ensure their understanding of the requirements which would govern approval of their application. This will be emailed to any interchange clean-up groups upon registration. The group representative must ensure that the “Acknowledgment Form A” is signed by the volunteers on or before the day of the clean-up and before the clean-up begins.
  • It is the responsibility of the participants to ensure that provisions for transportation, supervision, safety equipment and required medical / first aid are available.
  • No litter clean-up is to be performed until every member of the group is wearing a safety vest which is provided by or approved by the Department of Public Works. Borrowed supplies must be returned to the Department of Public Works or the relevant Waste Management Authority the next business day following the clean-up.
  • Volunteers are encouraged to wear CSA approved safety boots, hard hats, gloves and long sleeve shirts. The group and individuals are to obey and abide by all pertinent safety laws and regulations.
  • Groups are to begin their clean-up at the start of the deceleration lane taper and terminate at the end of the acceleration lane taper in both directions. The area will be marked by a Department of Public Works representative before the clean-up proceeds.
  • The litter clean-up operation is to proceed along one side of the adopted highway section at a time and within the limits of this section. Parking is not permitted on the 100 series highway and / or on ramps. All vehicles are to park on side roads or in parking areas off the shoulder of the road and vehicles should be parked as far away as possible from the interchange on one side of the secondary roadway (minimum of 60m from the ramps) only and away from the traveled portion of the highway ensuring no individuals remain in a parked vehicle during the clean-up. Access to the clean-up area will not be permitted from the 100 series roadway and / or from the ramps. All volunteers must confine their activities to the ditch and off the shoulder except to deposit full bags on the shoulder for later pick-up.
  • For interchange clean-ups, volunteers must stay behind the ditch line and may not pick up litter on the roadway, shoulder (whether paved or gravel), medians, bridges, overpasses, or around other structures between the ramps and the 100 series highway or at locations that could pose a danger to the individual and / or the motorist. Volunteers may not pick up litter in the areas where the deceleration and acceleration ramps meet the 100 series highway. All interchange clean-up volunteers must be over the age of 16.
  • Two volunteers from the group organization will assist the Department representative to pick litter between the ramps and the 100 series highway (quadrants). The volunteers are not permitted to pick up litter in the gore area (section of highway where the exit / entrance ramps meet the main roadway) and are also required to keep a minimum distance of 5m from the columns and the back slope (concrete) protection on the bridge. In the quadrants the volunteers are required to stay behind the ditch line and exercise extra precaution when picking up litter in these sections. It is recommended that the group representative meet with Department staff to ensure that the area of litter pickup in the quadrant is identified.
  • The litter clean-up must be confined to the section registered to the sponsoring group.
  • The group may be responsible for transporting litter bags to an approved landfill or pre-arranged site. Call your local Department of Public Works office to check if staff are available to pick up the litter bags. During the clean-up, all materials, substances, containers and large animal carcasses not suitable for removal by the members of the group must be marked with a coloured ribbon on a stake or near the shoulder of the road.
  • Volunteers must not have in their possession, or consume, illegal drugs, cannabis, or alcoholic beverages immediate before or during clean-up activities.
  • No pets are to be present during the clean-up.
  • No Walkman, earbuds, headphones, or other similar devices which may impede hearing are to be used during clean-up.
  • Do not wear clothing that might divert the attention of motorists during the clean-up. Wear clothing that will not impair vision or movement during the clean-up.
  • If items of value are found, surrender them to your group representative, who in turn will surrender them to the nearest police station.
  • Any recyclable material such as cans or bottles can be collected and taken away by the group to raise funds.
  • Litter clean-up must be suspended when weather conditions become inclement (i.e., fog, rain, high winds, storms, etc.) Work only during daylight hours (1 hour after sunrise and 1 hour before sunset).
  • All objects should receive appropriate care when handled. Proper consideration should be given to the type of material that various ages of volunteers pick-up and place in litter bags. Any suspicious or unfamiliar objects should be flagged and left alone. Examples of material to be flagged are car batteries, medical waste, paint, etc. Report any animal carcasses and hazardous substances or containers found and flagged.
  • Contact the Public Works base representative after completion of each litter clean-up to arrange for return of safety vests, unused garbage bags, flagging material and report any animal carcasses and hazardous substances or containers found and flagged. Failure to do this will result in the group or individual being charged for the replacement costs of these items. In addition, volunteers are encouraged to wear CSA approved safety boots, hard hats, long sleeved shirts and gloves.
  • When the sponsoring group fulfills the necessary requirements, Adopt-A-Highway signs will be posted on secondary roadways only and located outside the control of access boundary (60m beyond the end of the ramp). If the roadway is not a controlled access roadway, the location of the sign will be approved by the Area Manager.

Permission

I acknowledge that I have read the Waiver and agree to all terms and conditions within. Note: This waiver must be filled out 2 (two) weeks before the proposed clean-up. Volunteers younger than 18 years of age must have their waiver signed by a parent or legal guardian.
